1. Scope
These terms apply to all orders placed through malihadi.ch between Panaxis International GmbH and consumers with a delivery address in Switzerland or the Principality of Liechtenstein.
2. Formation of contract
The presentation of products is not a binding offer but an invitation to place an order. The contract is formed when we confirm your order by email.
3. Prices
All prices are in Swiss francs (CHF) including any applicable VAT, plus the shipping costs shown during the order process. Panaxis International GmbH is not currently entered in the VAT register; no VAT is shown on invoices. The price displayed at the time of the order applies.
4. Payment
Payment is made by advance bank transfer to the account of Panaxis International GmbH stated in the order confirmation. Please quote your order number as the payment reference; without it the payment cannot be matched to your order. Goods are dispatched once the full invoice amount has been received. If payment is not received within 10 days of the order confirmation, we may withdraw from the contract. Further payment methods may be offered during the order process; the options shown there apply.
5. Delivery
We deliver to Switzerland and Liechtenstein; delivery to other countries is possible on request (info@malihadi.ch). Shipping is normally by Swiss Post. Delivery usually takes 2–5 working days after receipt of payment; we will notify you by email of any delay. Shipping costs are shown in CHF during the order process before the order is completed. Delivery dates are non-binding unless expressly confirmed in writing.
6. Returns
Swiss law grants no statutory right of withdrawal for online orders. We voluntarily grant a right of return of 14 days from receipt, for non-perishable, unopened goods in their original packaging. Please give us advance notice of a return by email to info@malihadi.ch . The customer bears the cost of return shipping, unless the return is due to a defect or an incorrect delivery. Foodstuffs and other perishable goods, and goods sealed for reasons of hygiene where the seal has been opened, are excluded from return — unless the goods were defective on receipt. Refunds are made in CHF by transfer to the account from which payment was made, normally within 10 working days of receipt and inspection of the return.
7. Warranty
Please inspect the goods immediately on receipt and report any obvious defect, or a damaged, incomplete or incorrect delivery, within 7 days by email to info@malihadi.ch, ideally with a photo. At our discretion we will supply a free replacement or refund the purchase price including shipping costs. Otherwise the statutory provisions of Art. 197 et seq. of the Swiss Code of Obligations (OR) apply. Handmade products naturally vary in colour, dimensions and texture; this is not a defect but a characteristic of handwork.
8. Governing law and place of jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Baar, Canton of Zug. Mandatory statutory places of jurisdiction — in particular those in favour of consumers under Art. 32 of the Swiss Civil Procedure Code (ZPO) — are expressly reserved.
